NPDES Construction Generic Permit

What is it?
The NPDES Construction General Permit (CGP) is a U.S. Environmental Protection Agency (USEPA) requirement regulating stormwater discharges from construction sites that disturb one or more acres (or less than one acre if part of a common plan). In Florida, the Florida Department of Environmental Protection (FDEP) implements this program by requiring operators to submit a Notice of Intent (NOI) via the Florida Department of Environmental Protection iNOI system, develop a Stormwater Pollution Prevention Plan (SWPPP), and implement Best Management Practices (BMPs).
Who needs this service?
- Contractors & Developers: Any clearing, grading, or excavating activities that disturb at least one (1) acre, or less than one (1) acre if is part of a larger, common plan.
What does it include?
- Submit NOI: Submit a Notice of Intent (NOI) electronically to FDEP.
- Develop SWPPP: A Stormwater Pollution Prevention Plan (SWPPP) must be created, focusing on erosion, sedimentation, and waste management.
- Implement BMPs: Control measures such as silt fences, sediment basins, and FODS Trackout Control Mats must be used.
- Inspections: Sites must be inspected every 7 days and within 24 hours of a 0.5-inch or greater rain event.
- Termination: A Notice of Termination (NOT) must be submitted upon project completion.
Why is it important?
- Failure to comply, such as starting work without a SWPPP, can result in severe penalties, including stop-work orders and fines of $10,000+ per day.
- Pollutant discharges create significant ecological impact for the natural environment and other protected species.
