When Is a Permit Required?
A permit is needed if you need to disturb the ground within 25 feet of a gopher tortoise burrow. Without one, you could face fines and project delays.
What You’ll Need for a Permit and Relocation?
To apply for a permit and relocate gopher tortoises, you will need:
- Land Ownership: Confirmation of ownership or written authorization from the owner.
- Building Site Plan: A detailed layout showing areas impacted by construction.
- Building Permit: Either a current permit or proof of a permit application.
How Fast Can You Get a Permit?
We will submit your application within 1-3 days, but it typically takes 3 to 5 weeks for the FWC to issue a permit.

What are my Relocation Options? - where do the Tortoises go?
There are two primary options for relocating captured tortoises, each with its own tradeoffs:
On-Site Relocation:
This option is available for projects with 10 or fewer burrows and is the most affordable. However, it requires leaving a portion of the land in its natural, undisturbed state, which may necessitate adjustments to your building site plan. Off-Site Relocation:
This is the most common option, where tortoises are relocated to FWC-approved recipient sites / sanctuaries at a per-tortoise fee. While this approach allows you full use of the entire property without any restrictions, it does come with a higher cost compared to on-site relocation due to the third-party sanctuary fees involved
